9. ELIGIBILITY

11. LIMITATION OF LIABILITY

Winston Warren Commercial is not liable for any delays, failures, or errors in SMS delivery, including those caused by network outages, carrier issues, or technical malfunctions beyond our control. Our aggregate liability under these Terms shall not exceed the amount you paid us in the twelve months prior to the claim, or $100, whichever is greater.

12. GOVERNING LAW

These Terms are governed by the laws of the United States as applicable to interstate commercial communications, without regard to conflict of law principles. Any disputes arising from this program will be resolved through good-faith negotiation, and if necessary, binding arbitration.
